Any dispute relating in any way to your visit to CSI Entertainment, Inc or to products you purchase through CSI Entertainment, Inc shall be submitted to confidential arbitration in New York, except that, to the extent you have in any manner violated or threatened to violate CSI Entertainment, Inc’s intellectual property rights, CSI Entertainment, Inc may seek injunctive or other appropriate relief in any state or federal court in the state of New York, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, such as our return policy, posted on this site. These policies also govern your visit to CSI Entertainment, Inc. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
CSI Entertainment, Inc does not, as a condition of permitting Visitors to browse its Websites, collect or require Visitors to furnish Personally-Identifying Information (as defined below). Like most website operators, CSI Entertainment, Inc collects from Visitors Non-Personally-Identifying Information of the sort that web browsers and servers typically make available, such as Internet Protocol (“IP”) address, browser type, language preferences, referring site, and date and time of each visitor request. Non-Personally-Identifying Information is information that, without more, cannot be directly associated with a specific person or entity. CSI Entertainment, Inc’ purpose in collecting Non-Personally-Identifying Information is to better understand how Visitors use the Websites. From time to time, CSI Entertainment, Inc may release Non-Personally-Identifying Information, uncorrelated with Personally-Identifying Information, in the aggregate, e.g., by publishing a report on trends in the usage of its Websites.
A Web beacon, or Web bug, is a sometimes-invisible image embedded in a Web page, Web-based document or e-mail message. Web beacons permit website operators or third parties to monitor the IP address and other information about the browser and computer downloading the image. It is possible to use Web beacons in combination with Personally-Identifying Information to profile the online activities of website visitors. CSI Entertainment, Inc and certain of its contractors, including those who provide links to the Websites, may use Web beacons to help track the movements of Visitors on the Websites, so as to provide a more customized and efficient Visitor experience. As with cookies, CSI Entertainment, Inc also uses Web beacons, in combination with Personally-Identifying Information and other information, to facilitate Subscribers’ interactions with the Websites and Services.
Subscribers and Registered Visitors
In addition to the information that it collects from Visitors generally, CSI Entertainment, Inc may collect from its Subscribers and Registered Visitors a range of Personally-Identifying Information. Personally-Identifying Information is information that, without more, can be directly associated with a specific person or entity, e.g., a name, address, telephone number, email address. Personally-Identifying Information also includes information about a person or entity’s activities – including as gathered by means of cookies, Web beacons or in some other manner – when linked to information directly associated with them. CSI Entertainment, Inc may collect Personally-Identifying Information from Subscribers and Registered Visitors as necessary or useful to provide the Services, including but not limited to as may facilitate CSI Entertainment, Inc’: routing and transmission of Content and other Services-related information; credit check, billing and payment processing functions; provision of customer service; identification of Subscribers and Registered Visitors for account administration purposes; detection and prevention of unauthorized uses of the Services; and carrying out of any other activity described in or contemplated by the End User Agreements. The type and amount of Personally-Identifying Information that CSI Entertainment, Inc collects varies from Subscriber-to-Subscriber, but could include, without limitation and in addition to as stated in the End User Agreements:
* Name, address and telephone number;
* Email address;
* Credit card or Debit Card Information;
* Billing, payment, deposit and customer service histories;
* Website usage history and Website preferences, including without limitation as gathered by means of cookies, Web beacons and other technologies;
* Services options and Services consumption history;
* Technical information relating to computer; and
* Password, PIN or other security-related information.
CSI Entertainment, Inc also collects Personally-Identifying Information – for example, email addresses, passwords, wireless telephone numbers and the like – from those of its Visitors who, as a condition of engaging in certain uses of the Websites, register with CSI Entertainment, Inc (“Registered Visitors”). Subscribers and Registered Visitors can always refuse to supply Personally-Identifying Information, with the caveat that it may prevent them from using some or all of the Services or from engaging in certain uses of the Websites.
From time to time, CSI Entertainment, Inc may combine the Personally-Identifying Information it collects from Subscribers and Registered Visitors with other information that it lawfully receives from other sources, such as third-party vendors of the Services, consumer reporting agencies and marketing information firms (“Supplemental Personally-Identifying-Information”). CSI Entertainment, Inc may use and disclose Supplemental Personally-Identifying-Information for the same purposes, in the same manner and under the same conditions as Personally-Identifying Information generally.
A cookie performs the same function with respect to a wireless telephone as with a computer. CSI Entertainment, Inc and certain of its vendors and suppliers may use wireless cookies, in combination with Personally-Identifying Information and other information, to facilitate the offering of various wireless-based Services. Depending on a Subscriber’s Wireless Telephone and on the Service, such cookies may be placed on the Wireless Device or on servers owned or operated by CSI Entertainment, Inc or the vendor or supplier offering the Service.
Disclosure of Personally-Identifying Information
By Law or to Protect Rights
CSI Entertainment, Inc may disclose Personally-Identifying Information when required to do so by law, or when CSI Entertainment, Inc believes in good faith that disclosure is reasonably necessary to protect the property or rights of CSI Entertainment, Inc and its Affiliates, contractors and suppliers, other third parties, or the public at large.
CSI Entertainment, Inc would like to provide Subscribers and Registered Visitors with notice of new products, services and features, whether offered by CSI Entertainment, Inc or others. When such information concerns the products, Services and features of CSI Entertainment, Inc or its Affiliates, CSI Entertainment, Inc and its Affiliates will provide such information to those of its Subscribers and Registered Visitors who have opted to receive it by means of posted mail and email directed to those Subscribers’ and Registered Visitors’ most recently submitted addresses. Subscribers and Registered Visitors who opt to receive product, service and features-related communications from third parties may also receive such information by posted mail or email. CSI Entertainment, Inc will not send Subscribers or Registered Visitors text messages concerning the Services or new products, services or features without first obtaining those Subscribers’ consent to do so. If you wish to opt-in or opt-out of receiving certain marketing communications, you should contact CSI Entertainment, Inc Customers Service.
Contests, Giveaways and Surveys
From time to time, CSI Entertainment, Inc and its Suppliers may offer you the opportunity to participate in contests, giveaways and other promotions. Any information you submit in connection with such activities will be treated – by CSI Entertainment, Inc and its Suppliers – in accordance with this Agreement. From time to time, CSI Entertainment, Inc may also ask you to participate in surveys designed to help CSI Entertainment, Inc improve the Websites and Services. Any Personally-Identifying Information provided to CSI Entertainment, Inc in connection with any survey will be used only by CSI Entertainment, Inc, its Affiliates and its contractors related to that survey, and will not be disclosed to any other entity, except in aggregated, Non-Personally-Identifying form.
CSI Entertainment, Inc does not disclose Subscribers’ and Registered Visitors’ Personally-Identifying Information to third parties for the third parties’ direct marketing purposes, as and to the extent required by California Civil Code 1798.83.
Third Party Collection of Personally-Identifying and Other Information
Information Relating to Minors
All use of the Websites and Services is intended for, and is limited to, those 18 years of age or older. CSI Entertainment, Inc does not solicit or collect information – in particular Personally-Identifying Information – from anyone under 18 years of age. As stated in the End User Agreements, if you are less than 18 years of age, you must not make any use of the Websites or Services, and Subscribers must not allow those under 18 years of age from making any use of the Websites or Services.
Protection of Personally-Identifying Information
CSI Entertainment, Inc takes all physical, electronic and procedural measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of Personally-Identifying Information.
Updating of Personally-Identifying Information
CSI Entertainment, Inc permits its Subscribers and Registered Visitors to freely update, correct, or delete any Personally-Identifying Information maintained by CSI Entertainment, Inc. To do so, Subscribers and Registered Visitors need only contact CSI Entertainment, Inc Customer Service.
